SAFCEI and ELA-JHB submit that it would be irregular for the NNR to grant a NISL in circumstances where Eskom’s CEO has indicated that it is unable to build new nuclear power (due to its precarious financial position), where the IRP2019 indicates that preparations for a new nuclear build programme should commence with the development of a roadmap, where an RFI issued by the DMRE indicates that it is considering various nuclear reactor technologies (including SMRs), and where no nuclear s34 determination has been designating Eskom as the generator.
